By accessing the website, opting in, booking a call, or enrolling in any program, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use our Services. By using the Services, you represent that you meet this requirement.

You also confirm that you are physically and mentally fit to participate in fitness and nutrition coaching, or that you have consulted a qualified medical professional before doing so.

2. Nature of Our Services

BeFit With OmSath provides educational content, fitness coaching, nutrition guidance, accountability support, and structured transformation programs designed primarily for women aged 30 and over.

3. Account, Enrollment, and Payments

When you enroll in a paid program:

  • You agree to provide accurate, complete, and current information.
  • You authorize us (or our payment processor) to charge the agreed-upon fee for the program you select.
  • All fees are quoted in the currency displayed at checkout and are inclusive or exclusive of taxes as indicated.
  • Access to program materials is granted only after successful payment.
  • You are responsible for keeping your login credentials (if any) confidential.

4. Refunds and Cancellations

Our refund policy is communicated at the point of enrollment and may vary by program. Unless a specific refund guarantee is stated in writing for the program you purchase, all sales are final once the program has been delivered or accessed.

If your program includes a refund window or guarantee, the conditions for that refund (such as completion of assigned tasks, submission of proof of work, or a specific time frame) must be met before a refund is issued.

To request a refund, contact us using the details in Section 14 within the eligible window.

5. User Responsibilities

You agree to:

  • Use the Services for lawful, personal, non-commercial purposes only.
  • Provide accurate information about your health, fitness, and lifestyle so we can guide you safely.
  • Consult a doctor before beginning any fitness or nutrition program, especially if you have a pre-existing condition, are pregnant, recovering from injury, or taking medication.
  • Take full responsibility for your own actions, decisions, and results.
  • Not share, resell, redistribute, or publicly post any program materials, recordings, plans, or coaching content.

6. Intellectual Property

All content on our website and within our programs — including text, videos, images, logos, plans, workout routines, nutrition guides, branding, and the “BeFit With OmSath” name — is owned by us or licensed to us and is protected by intellectual property laws.

You receive a personal, non-transferable, non-exclusive, revocable license to use the materials for your individual transformation journey. Any other use — including copying, sharing, reselling, modifying, or creating derivative works — is strictly prohibited without our prior written permission.

7. Testimonials and Results

Any testimonials, case studies, or before-and-after results shown on our site, in our VSL, or in marketing materials reflect the experiences of specific individuals. They are not guarantees, promises, or projections of the results you will achieve. Individual results vary based on effort, consistency, starting point, genetics, lifestyle, and many other factors. 8. Prohibited Conduct

When using the Services, you agree not to:

  • Engage in harassment, abuse, hate speech, or threatening behavior toward coaches, staff, or other clients
  • Attempt to gain unauthorized access to our systems or content
  • Use the Services to violate any law or third-party rights
  • Upload or transmit viruses, malicious code, or harmful content
  • Misrepresent your identity, health status, or affiliation
  • Record, screenshot, or distribute private coaching sessions or community discussions without consent

We reserve the right to suspend or terminate access to any user who violates these rules, without refund.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, merchantability, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any specific outcome will be achieved.

10. Limitation of Liability

To the fullest extent permitted by law, BeFit With OmSath, its founder, coaches, employees, and affiliates shall not be liable for:

  • Any direct, indirect, incidental, consequential, special, or punitive damages
  • Personal injury, illness, or aggravation of any pre-existing condition arising from your participation
  • Loss of profits, data, or business opportunities
  • Any failure to achieve a specific weight-loss, pain-reduction, or fitness outcome

Our total cumulative liability to you for any claim arising out of or related to these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BeFit With OmSath, its founder, coaches, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any health complication you experience as a result of not following medical advice or not disclosing relevant health information

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to us or other clients. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Services shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts located in India.
